1. Acceptance of Terms

By downloading, installing, or using the Tonight's Dinner iOS app (the "App") or visiting tonights-dinner.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App or Site.

These Terms form a legal agreement between you and Orri Antonsson ("we," "us," or "our"). References to the "Service" mean the App, the Site, and all related features and content we make available.

Our Privacy Policy is incorporated into these Terms by reference. By accepting these Terms you also accept our Privacy Policy, which describes how we collect, use, and protect your personal information. You can read it at https://tonights-dinner.com/privacy.

2. Eligibility

You must be at least 13 years old to use the Service.
If you are between 13 and 18 (or the age of majority in your jurisdiction, whichever is higher), you may only use the Service with the consent of a parent or legal guardian who agrees to these Terms on your behalf.
By using the Service you confirm that you meet these age requirements.
Consistent with our Privacy Policy, we do not knowingly collect personal information from children under 13. If we learn that a user is under 13, we will terminate their account. See the Privacy Policy (Section 12) for details.

3. Accounts

3.1 Registration

You can create an account using an email address and password, Sign in with Apple, or Google Sign-In.
You agree to provide accurate, current, and complete information when registering, and to keep it up to date.
You must not create an account on behalf of someone else without their permission, or use a false identity.

3.2 Your Responsibility for Your Account

You are responsible for keeping your login credentials confidential.
You are responsible for all activity that occurs under your account, whether or not you authorized it.
If you suspect unauthorized access to your account, contact us immediately at contact@tonights-dinner.com.

3.3 Account Deletion

You may delete your account at any time directly in the App:

Open the App and go to the Profile tab.
Scroll to Delete account at the bottom.
Tap Delete account, then confirm by tapping Delete my account.

This permanently deletes your account and all associated data. For full details on what is deleted and what happens to your data, see Section 10 of our Privacy Policy. If you cannot access the App, you may also request deletion by emailing contact@tonights-dinner.com.

4. Subscriptions and Billing

4.1 Free and Pro Features

Tonight's Dinner offers free features available to all users and a paid tier called Tonight's Dinner Pro, available as a Monthly or Annual auto-renewable subscription. Features included in each tier are described in the App and on the Site.

4.2 Pricing

Prices for Pro subscriptions are displayed in the App before purchase. Prices are set in the applicable App Store currency for your region and may vary by country.

4.3 Billing Through Apple

All Pro subscriptions are sold through the Apple App Store. Payment is charged to your Apple ID at confirmation of purchase. We do not directly process or store your payment information. By purchasing a subscription you also agree to Apple's standard End User License Agreement (EULA) at apple.com/legal/.../stdeula.

4.4 Auto-Renewal

Your subscription renews automatically at the end of each billing period (monthly or annual) unless you turn off auto-renewal.
To avoid being charged for the next period, you must cancel at least 24 hours before the end of the current period.
You can manage or cancel your subscription at any time in Settings > Apple ID > Subscriptions on your device, or via the App Store on any Apple device signed in to your Apple ID.

4.5 Refunds

Refunds are handled entirely by Apple, not by us. If you believe you are entitled to a refund, please contact Apple Support at support.apple.com or submit a refund request through the App Store. We have no ability to issue refunds for App Store purchases.

4.6 Free Trials

If a free trial is offered, it will be described in the App at the time of sign-up. Your subscription will convert to a paid subscription automatically at the end of the trial period unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription during the trial period.

4.7 Price Changes

If we change subscription pricing, we will give you reasonable advance notice. Continued use of a Pro subscription after a price change takes effect constitutes your acceptance of the new price.

5. User Content

5.1 Your Content

The Service allows you to create, save, and manage your own recipes and other content ("User Content"). You retain full ownership of your User Content.

5.2 License You Grant Us

By submitting or saving User Content in the Service, you grant us a non-exclusive, royalty-free, worldwide license to host, store, reproduce, and display your User Content solely to the extent necessary to operate and provide the Service to you. This license ends when you delete the relevant content or delete your account.

We do not claim ownership of your User Content, and we do not use it for advertising or share it with third parties outside of what is described in our Privacy Policy.

5.3 Your Responsibilities

You are solely responsible for your User Content.
You confirm that you have all rights necessary to submit the content and to grant us the license above.
You agree not to submit content that infringes a third party's intellectual property or other rights.

6. Acceptable Use

You agree to use the Service only for its intended purpose and in compliance with all applicable laws. You must not:

Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
Scrape, crawl, or systematically extract data from the App or Site using automated tools.
Reverse engineer, decompile, or attempt to derive the source code of the App.
Attempt to circumvent or interfere with the App's security features, subscription verification, or access controls.
Upload, transmit, or share content that is defamatory, obscene, infringing, or otherwise harmful.
Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
Use the Service in any way that could damage, disable, overburden, or impair our infrastructure or systems.
Attempt to gain unauthorized access to any part of the Service or accounts of other users.

Violations of this section may result in immediate suspension or termination of your account.

7. Intellectual Property

7.1 Our Property

The App, the Site, and all original content we create — including but not limited to the Tonight's Dinner name, logo, branding, interface design, and original editorial content — are owned by or licensed to Orri Antonsson and are protected by copyright, trademark, and other applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of our intellectual property without our prior written permission.

7.2 Third-Party Recipe Content

Some recipe content available in the App may be sourced from third parties. That content remains the intellectual property of its respective owners. We do not represent that we own third-party recipe content.

7.3 Your Content

As described in Section 5, you retain ownership of your User Content.

8. Third-Party Services

The Service relies on and integrates with third-party services, including:

Apple — App Store distribution, in-app purchase processing, and Sign in with Apple.
Google — Google Sign-In authentication.
Supabase — Back-end database, authentication, and storage infrastructure.
RevenueCat — Subscription state management and verification.
Third-party recipe sources — Recipe data may be sourced from external providers.

These services operate under their own terms and privacy policies. We are not responsible for the practices, availability, or content of any third-party service. Your use of third-party services is governed by their respective terms. We encourage you to review them.

The App or Site may also contain links to external websites. We are not responsible for the content or privacy practices of those websites.

9. Disclaimers

9.1 "As Is" Service

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, to the fullest extent permitted by applicable law. We do not warrant that:

The Service will be uninterrupted, error-free, or available at any particular time.
Results obtained from using the Service will be accurate or reliable.
Any defects will be corrected.

9.2 Not Professional Advice

Tonight's Dinner provides recipe ideas and meal-planning suggestions for general informational and convenience purposes only. Nothing in the Service constitutes professional nutritional, dietary, allergy, or medical advice. In particular:

Recipe suggestions are not tailored to your individual health conditions or medical needs.
We do not independently verify the accuracy of nutritional information, ingredient lists, or allergen information associated with recipes.
You are solely responsible for checking ingredients and allergens before preparing or consuming any recipe, especially if you or someone in your household has a food allergy, intolerance, or medical dietary requirement.

If you have specific dietary or health needs, consult a qualified healthcare or nutrition professional.

10. Limitation of Liability and Indemnification

10.1 Limitation of Liability

To the fullest extent permitted by applicable law:

We will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
This includes, without limitation, damages for loss of data, loss of goodwill, service interruption, or any other intangible loss.
Our total cumulative liability to you for any claims arising under or related to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) USD $10 (or equivalent in your local currency).

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.

10.2 Indemnification

You agree to defend, indemnify, and hold harmless Orri Antonsson and its officers, directors, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

Your use of the Service in violation of these Terms.
Your User Content.
Your violation of any applicable law or third-party right.

11. Termination and Suspension

11.1 By You

You may stop using the Service and delete your account at any time. See Section 3.3 for account deletion instructions.

11.2 By Us

We may suspend or terminate your access to the Service, with or without notice, if:

You breach these Terms or our Acceptable Use policy (Section 6).
We are required to do so by law or legal process.
We reasonably believe your account poses a security risk or harm to other users or the Service.

11.3 Effect of Termination

On termination or suspension:

Your right to use the Service ends immediately.
Sections 5.3, 7, 9, 10, 13, and 14 survive termination.
If your account is terminated for breach, you are not entitled to a refund of any prepaid subscription fees. Refund eligibility is governed by Apple's policies (see Section 4.5).

12. Changes to the Service and These Terms

12.1 Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time. We will try to give reasonable advance notice of significant changes, but we are not obligated to do so.

12.2 Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you through the App or by email. Your continued use of the Service after updated Terms are posted constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. The current version is always available at https://tonights-dinner.com/terms.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Iceland, without regard to its conflict-of-law provisions.

13.2 Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Iceland. Nothing in this section limits any mandatory consumer-protection rights you may have under the laws of your country of residence. If you are a consumer resident in the European Economic Area or the United Kingdom, you may also bring proceedings in the courts of the country where you live, and you keep the benefit of any mandatory provisions of the consumer-protection law of that country.

13.3 Consumer Rights

Nothing in these Terms limits any consumer rights you may have under mandatory applicable law in your jurisdiction that cannot be waived by contract.

14. General

Entire Agreement. These Terms, together with the Privacy Policy at https://tonights-dinner.com/privacy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Language. These Terms are written in English. Where a translation is provided, the English version controls in the event of any conflict.
